Voice Recording and the Law

The basic advice on this subject is that one party in the conversation must be aware that recording of the conversation is taking place and best endeavours must be made to advise the other party also. If the other party is not aware and has not given their consent it is illegal to play these recordings to a 3rd party.
Ways by which advising on recording may be given include verbal at the start of the conversation, pre recorded message information, advertising material, headed paper.
The data protection act also needs to taken into account with regard to the storing and access of telephone conversations.
